What is the Lawsuit about?

The Lawsuit alleges that defendants Synapse Group, Inc. and SynapseConnect, Inc. (together, “Synapse”) enrolled certain California consumers in automatic renewal or continuous service magazine subscriptions, and posted charges to the consumer’s credit card, debit card, or third party payment account, without first presenting the consumer with the automatic renewal offer terms in a clear and conspicuous manner. Synapse denies the claims in the Lawsuit and the Court has not decided which party is right. The parties have agreed to a Settlement to provide benefits to eligible Class Members and to resolve the case.

Who is considered a Class Member?

All individuals in California who, between May 17, 2012 and October 8, 2018, were enrolled by Synapse in an automatic renewal or continuous service magazine subscription.  Excluded from the Class are all employees of Synapse, all employees of plaintiffs’ counsel, and the judicial officers to whom this case is assigned.

What relief does the Settlement provide?

Synapse has agreed to pay the principal Settlement Amount of Four Million Nine Hundred Eighty Thousand Dollars ($4,980,000). If the Court grants final approval of the Settlement, each Participating Class Member will receive a pro-rata share of the Net Settlement Amount. The “Net Settlement Amount” is the Settlement Amount reduced by any sums awarded by the Court for attorneys’ fees, litigation expenses, any class representative service payments, and expenses of settlement admin-istration. The Settlement also provides for injunctive relief.

What are my options?

To potentially qualify for a monetary payment from the Settlement, potential Class Members must file a Claim. Click here to file a Claim.

If you do nothing, you will not be a Participating Class Member and you will not qualify to receive a monetary payment, but you will be bound by the release in the Settlement Agreement.

Excluded Class Members will not receive any consideration under the Settlement and will not be bound by any provision of the Settlement. Please visit the Long Form Notice or the FAQs for more information on how to exclude yourself.

You may write to the Court to comment on or detail why you do not like the settlement. Copies of the objection must be served on Class Counsel, Defendant’s Counsel and the Settlement Administrator. Please visit the Long Form Notice or the FAQs for more information on how to submit an objection.
